Terms and Conditions for FAQACT.AI

Welcome to Faqact.ai. These Terms of Service (“Terms”) govern your access to and use of the website located at https://www.faqact.ai (the “Site”) and any related services (collectively, the “Service”) provided by Faqact.ai (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms
By registering for, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. We may update these Terms from time to time (see Section 15 below). Your continued use of the Service after we post changes constitutes your acceptance of the revised Terms.

2. Description of Service
Faqact.ai provides a platform (“Service”) that allows businesses to convert FAQ pages into a fully functional FAQ bot (“Faqbot”) within minutes. You can sign up, submit your existing FAQ content, and have it transformed into an interactive bot that answers visitor questions automatically.

3. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age, have full power and authority to enter into these Terms, and will abide by them.

4. Account Registration
Registration Information. In order to use the Service, you must create an account by providing accurate information, including your name, email address, and any other information requested (“Account Information”).

Account Security. You are responsible for maintaining the confidentiality of your account credentials (e.g., password) and for all activities that occur under your account. You agree to notify us immediately at wiselin.jayajos@faqact.ai if you suspect any unauthorized access or other security breach.

5. Free Trial and Billing
Free Trial Period. All new users are eligible for a free trial period of two (2) months (the “Free Trial”). During the Free Trial, you will not be charged for using the Service, subject to these Terms.

Automatic Transition to Paid Plan. At the end of the Free Trial, unless you cancel in writing via your account settings or by emailing wiselin.jayajos@faqact.ai at least five (5) days before the Free Trial expires, your account will automatically transition to a paid subscription plan as outlined on our pricing page.

Payment Information. To enroll in a paid plan, you must provide valid payment information (e.g., credit card or other permitted methods). By providing payment information, you authorize us (or our third-party billing provider) to charge you recurring fees in accordance with the plan you select.

Refunds and Cancellations. All fees are non-refundable unless otherwise required by applicable law. You may cancel your subscription at any time through your account settings or by emailing wiselin.jayajos@faqact.ai. Cancellation takes effect at the end of your current billing cycle.

6. Ownership and License
Ownership of Service. The Site, Service, and all content, software, graphics, and other materials provided by us are owned by or licensed to Faqact.ai and are protected by intellectual property laws.

License to You. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your business purposes.

7. User Data Collection
Personal Data. We collect the following personal data from you upon registration and use of the Service:

Name

Email address

Payment information (e.g., credit/debit card details, billing address)
We collect and process this data to provide, maintain, and improve the Service; for billing purposes; and to comply with legal obligations. For details on how we use and protect personal data, please see our Privacy Policy.

Non-Personal Data. We also collect non-personal information automatically through web cookies and similar technologies, such as browser type, pages visited, time spent on pages, and clickstream data. We use this information to analyze trends, administer the Site, track users’ movements around the Site, and gather demographic information for aggregate use.

Your Responsibilities. You are responsible for ensuring that any personal data you upload to the Service (e.g., FAQ content containing third-party personal data) complies with all applicable laws, including data protection and privacy requirements.

8. Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to all actions we take with respect to your personal data in compliance with the Privacy Policy.

9. Acceptable Use
You agree not to:

Violate any applicable law or regulation in connection with your use of the Service.

Upload or transmit any content that infringes any third-party intellectual property rights.

Attempt to reverse engineer, decompile, or otherwise discover the source code of the Service.

Interfere with or disrupt the integrity or performance of the Service.

Use the Service to send unsolicited marketing or spam.
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these provisions.

10. Intellectual Property
Your Content. To the extent you provide any FAQ content or other materials to the Service, you retain ownership of that content. By submitting content, you grant us a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

Our Intellectual Property. All trademarks, service marks, trade names, logos, and other intellectual property displayed on the Site are our property or the property of our licensors. You agree not to use these marks without our prior written permission.

11. Termination
Termination by You. You may terminate your account at any time by canceling your subscription through your account settings or by emailing wiselin.jayajos@faqact.ai.

Termination by Us. We may suspend or terminate your account at any time and for any reason, including for violation of these Terms or if we believe your conduct threatens the security or integrity of the Service.

Effect of Termination. Upon termination, your right to access and use the Service will immediately cease. Any fees paid prior to termination are non-refundable. You remain responsible for any amounts due through the date of termination.

12. Disclaimers and Limitation of Liability
Disclaimer of Warranties. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FAQACT.AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNTS YOU HAVE PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

13. Indemnification
You agree to indemnify, defend, and hold harmless Faqact.ai, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Your violation of these Terms;

Your submission of any content that infringes or misappropriates a third party’s intellectual property rights;

Your violation of applicable laws or regulations.

14. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by Faqact.ai. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You access and use any third-party services at your own risk. We encourage you to review the terms and policies of any third party.

15. Governing Law and Venue
These Terms and any dispute arising out of or related to these Terms or your use of the Service shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the United Kingdom.

16. Changes to These Terms
We may modify these Terms at any time in our sole discretion. When we make changes, we will (i) post the updated Terms on the Site with a new “Last Updated” date, and (ii) send an email notification to the address associated with your account. Your continued use of the Service after we notify you of changes constitutes your acceptance of the updated Terms.
